Understanding Murder Charges Under Massachusetts Law

Massachusetts General Laws Chapter 265, Section 1 defines first-degree murder under three theories: deliberately premeditated malice aforethought (planning and intent to kill); extreme atrocity or cruelty; or the felony murder rule, which applies when a killing occurs during the commission or attempted commission of a crime punishable by death or life imprisonment. A conviction on any of these theories carries a mandatory sentence of life in prison without the possibility of parole.

Second-degree murder covers any unlawful killing with malice that doesn’t meet the first-degree threshold. Malice, the mental state the Commonwealth must prove, can be established three ways: intent to cause death, intent to cause grievous bodily harm, or intent to do an act that a reasonable person would recognize as carrying a plain and strong likelihood of death. A second-degree conviction carries a mandatory life sentence, with parole eligibility after a minimum term set by the sentencing court of no fewer than 15 years.

Voluntary manslaughter, a lesser homicide charge, may become relevant when a killing occurred without premeditation or malice, such as in a heat-of-passion situation.
