Quincy Vehicular Homicide Lawyer

Defense Against Vehicular Homicide Charges

Homicide by motor vehicle is a misdemeanor offense, but if you were under the influence of either drugs or alcohol at the time, you will be charged with a felony. In both cases, you will face a mandatory minimum sentence of imprisonment, substantial fines and loss of driver's license.

Committed defense of your case by an experienced attorney is absolutely critical. Massachusetts courts are tough on reckless, negligent and drunk drivers. If your attorney is extensively experienced with defending serious drunk driving cases and other traffic violations, you will be in the best position possible to obtain an outcome that will protect your future.

At Sweeney & Associates, LLC, our attorneys in Quincy have over 20 years of combined experience defending people in Quincy, Canton, the Greater Boston area and throughout Massachusetts who face all types of serious criminal charges. We know police officer probable cause, arrest, evidence and booking procedures thoroughly, and we know where mistakes are often made.

Our attorneys can provide you with comprehensive defense aimed at getting the charges against you dismissed or substantially reduced anywhere in Massachusetts. Contact us for a free, confidential case evaluation.

Vehicular Homicide Charges and Penalties if Convicted

Homicide by motor vehicle:

  • Misdemeanor criminal offense
  • Mandatory minimum sentence of 30 days in jail and up to 2.5 years in jail
  • Up to a $3,000 fine
  • 15-year driver's license loss for first offense

Homicide by motor vehicle while under the influence of an intoxicating substance and operating a motor vehicle recklessly or negligently:

  • Felony criminal offense
  • Minimum mandatory sentence of one year in jail but could face up to 15 years in state prison
  • Up to a $5,000 fine
  • 15-year driver’s license loss for first offense

Manslaughter while operating a motor vehicle:

  • An enhanced felony charge the prosecution may choose to pursue
  • Mandatory minimum sentence of five years and up to 20 years in prison
  • Up to $25,000 fine
  • 15-year driver’s license loss for first offense

The burden of proof lies with the prosecution, and the attorney you hire can make a big difference in the outcome of your case and how your case can be defended. The prosecution must prove you were under the influence of alcohol or other illegal substance such as marijuana, and a skilled defense attorney will be able to attack the police investigation and the procedure used to determine whether you were under the influence.

We can be a challenge for the prosecution, as they must prove that you were operating the vehicle recklessly or negligently, and directly link your actions to the death of another person.
