What Massachusetts Law Means by “Child Enticement”

The offense is codified at G.L. c. 265, Section 26C(b). Under the statute, “entice” means to lure, induce, persuade, tempt, incite, solicit, coax, or invite. The charge applies when the alleged victim was under 16, or when the defendant believed the person to be under 16, regardless of actual age.

Four Elements the Commonwealth Must Prove

To secure a conviction, prosecutors must establish each of the following beyond a reasonable doubt:

  • Enticement through words, gestures, or other means
  • The alleged victim was under 16 or believed to be under 16
  • The defendant enticed the person to enter, exit, or remain within a vehicle, dwelling, building, or outdoor space
  • The defendant acted with specific intent to commit an enumerated underlying offense

The intent element matters. In Commonwealth v. LaPlante, the court found that offering a ride and demanding someone get into a truck was, standing alone, insufficient to prove intent to forcibly confine the alleged victim. Prosecutors must connect the enticement to a specific intended crime.

Qualifying Underlying Offenses

The statute lists approximately two dozen offenses that satisfy the intent element, including indecent assault and battery, rape and abuse of a child under 16, assault with intent to commit rape, inducing a minor into prostitution, open and gross lewdness, and disseminating matter harmful to a minor. Any offense involving the use or attempted use of force also qualifies.

Sentencing & Sex Offender Registration

A conviction carries up to 5 years in state prison, or up to 2.5 years in a house of correction, along with a fine of up to $5,000. Because child enticement is classified as a sex offense under Massachusetts law, a conviction also triggers sex offender registration and treatment obligations through the Sex Offender Registry Board. Those registration consequences can follow a person long after any sentence is served.

Online Communications & Sting Operations

Many child enticement charges arise from online exchanges rather than in-person contact. Law enforcement sting operations, in which an officer poses as a minor, are common. The Supreme Judicial Court has ruled that factual impossibility isn’t a defense to this charge, meaning it’s legally irrelevant that the “child” a defendant communicated with wasn’t a real person, per Commonwealth v. Disler and Commonwealth v. Filopoulos.

The Commonwealth must still prove the defendant intended his advances to be directed at an underage person. Intending consensual relations with an adult doesn’t satisfy this element, even if the target turns out to be a child. Courts have also held that enticement can occur without any verbal reference to sexual matters, which makes the factual record in each case critical to the defense analysis.
