Massachusetts SORB Registration Relief and Termination

How to get OFf the Sex Offender registry

Relief from SORB Registration

Registering as a sex offender can impact every aspect of your life from where you live to where you work to where you travel. If you were convicted of a crime in a different state or of a federal crime, SORB may claim you have a duty to register in Massachusetts as a sex offender. An experienced sex offender registry attorney can review your case and determine whether SORB is correct. There are times when your out-of-state conviction or federal conviction will not qualify as a “like violation” for purposes of the Massachusetts sex offender registry laws. If your conviction is not a “like violation,” then you cannot be required to register. Your attorney can file a motion for relief from registration with SORB. If the Motion is allowed, then you will not have to register as a sex offender. If the motion is denied, then you can appeal SORB’s decision to Superior Court and argue to a judge that your conviction is not a “like violation” under Massachusetts law. If the judges agrees, they can also relieve you from your obligation to register. Contact an experienced attorney today for a consultation.

Termination of Your Obligation to Register as a Sex Offender

If you are a Level 2 or Level 3 offender, not only does registration impact your opportunities in life, but your registration information is also published on the internet including your name, home address, work address, sex offense conviction(s), and other identifying information.

Whether you are a Level 1, Level 2, or Level 3 offender, you may be eligible to file a motion with SORB to terminate your registration obligation if you committed your sex offense more than ten years prior. An experienced sex offender registry attorney can assist you in presenting the best possible case to SORB in your efforts to get off the registry.

There are many factors that go into whether your obligation to register will be terminated including the type of charge, how long you have been on the registry, how long you have lived in the community without committing any offenses, your age, your health, successfully completing sex offender treatment, etc. There is no one size fits all when it comes to termination from the registry.

Contact Attorney Sabrina Bonanno for a consultation on your ability to get off the registry. If you are eligible to seek termination, then we would file a motion on your behalf asking that your registration obligation be terminated. While sometimes the motion is allowed before the hearing, more often than not, you would then have a classification hearing to determine your current risk of re-offense and degree of danger.

If SORB agrees with the motion, then your obligation to register would be terminated. If SORB denies the motion, you can appeal to Superior Court and ask a judge to terminate your obligation to register. If the judge agrees, then they can also terminate your obligation to register as a sex offender.
