Vehicular Homicide Charges and Penalties if Convicted

Homicide by motor vehicle:

  • Misdemeanor criminal offense
  • Mandatory minimum sentence of 30 days in jail and up to 2.5 years in jail
  • Up to a $3,000 fine
  • 15-year driver's license loss for first offense

Homicide by motor vehicle while under the influence of an intoxicating substance and operating a motor vehicle recklessly or negligently:

  • Felony criminal offense
  • Minimum mandatory sentence of one year in jail but could face up to 15 years in state prison
  • Up to a $5,000 fine
  • 15-year driver’s license loss for first offense

Manslaughter while operating a motor vehicle:

  • An enhanced felony charge the prosecution may choose to pursue
  • Mandatory minimum sentence of five years and up to 20 years in prison
  • Up to $25,000 fine
  • 15-year driver’s license loss for first offense
